Terms of Use

Acceptance

These Terms of Use are a contract between you and Guaraci. To create an account, you must accept them. How we handle your data is described in the Privacy Policy, which is part of these terms.

Definitions

• Guaraci: trade name of JONATHAN DIAS REZENDE LTDA, which offers GymDogs and is identified in section 17.
• GymDogs or service: the GymDogs app, the gymdogs.app website and the support channels.
• User: anyone who uses the service.
• Team: a group of people who follow their own plans together. The team owner sets up the team; the coordinators help manage it.
• Organization: whoever brings teams together on GymDogs, such as a company, a gym or a coaching group, with an @ handle. It is the one that pays for the plan, when there is one.
• Organization owner: the person who subscribes to, changes and cancels the organization's plan.
• Medal: recognition given by GymDogs to anyone who reaches an adherence range on their own plan.
• Reward: a benefit that an organization promises, on its own behalf, to anyone who earns a medal.

What GymDogs is

GymDogs is a team workout app: each person sets their own plan, logs workouts by hand or through the sources they connect, and is measured by how much of the plan they fulfill. The team follows along and offers support, with no ranking.

GymDogs evolves over time: features may be added, changed or removed. When a change takes away something relevant from paying customers, we will give notice in advance, as stated in section 14.

Account and minimum age

GymDogs is for people 18 and older. By creating an account, you confirm that you are at least 18 years old. Accounts belonging to minors are deleted when discovered.

You agree to provide truthful information, keep access to your account to yourself and let us know if you notice any misuse. Each account is personal: do not share or transfer it.

Acceptable use

When using GymDogs, you may not:

• log fake workouts, manipulate data from the sources or use automated means to earn medals or rewards;
• harass, threaten, discriminate against, expose or offend other people;
• post content that is illegal, contains nudity, is violent, infringes third-party rights or shows other people without their permission;
• try to access other people's data or restricted areas, or circumvent security measures;
• use bots or automated scraping, or disrupt the operation of the service.

Medals and rewards obtained through fraud may be canceled.

Content you post

Photos, videos, stories and text you post remain yours. For GymDogs to work, you grant us a free, non-exclusive and limited license to store, process and display that content to the people you chose to share it with, while it is on the service. The license ends when you delete the content or delete your account.

You are responsible for what you post. We may remove content that violates these terms or the law. If you find something abusive, report it through the support form.

Organizations and teams

Anyone who creates an organization or manages a team agrees to:

• use the members' data that GymDogs shows or sends, such as adherence and medals, only to follow and encourage the team and to deliver rewards;
• not use that data for employment decisions against a member, such as performance reviews, discipline, dismissal or discrimination;
• not pressure anyone to allow their data to be viewed or to join a team;
• comply with the LGPD (Brazilian General Data Protection Law) regarding the data it receives: for what it receives through automatic delivery or takes outside of GymDogs, the organization is an independent controller and is responsible for how it uses that data.

Medals and rewards

A medal is a symbolic recognition and has no cash value. GymDogs calculates adherence with the data that comes from the sources and the logs; if a piece of data is wrong or gets corrected, the medal may be reviewed.

When an organization promises a reward:

• the organization is solely responsible for the promise, the rules, the delivery, the taxes and any authorizations required by law, such as for a commercial promotion, where applicable;
• Guaraci does not promote, sponsor, guarantee or deliver rewards, and is not liable for what the organization promises;
• the reward shown on the medal is the one the organization had set for that range when the cycle ended.

Paid plans, cancellation and withdrawal

• Using GymDogs is free. An organization with up to 6 people, counting all of its teams, does not pay either.
• Above that, the organization owner subscribes to a plan based on a range of number of people, monthly or yearly, which applies to all of the organization's teams. People who take part in the teams do not pay.
• Each person's first organization that goes above 6 people can use GymDogs for up to 2 months without paying, only once.
• Prices are shown in the app before you subscribe, in your region's currency.
• The subscription renews automatically on the card or through Automatic Pix until it is canceled.
• Moving up a range immediately charges the prorated difference for the remaining period. Moving down a range neither charges nor refunds anything and takes effect from the next renewal.
• Withdrawal: if you subscribed as a consumer, you can withdraw within 7 days of subscribing, through support, and we refund the full amount paid.
• Canceling, after that period, turns off renewal and keeps access until the end of the period already paid, with no prorated refund for the current period.
• If the renewal is not paid after the new billing attempts and the organization has more than 6 people, its teams are suspended: no one is removed and nothing is deleted. The owner has 30 days to pay or reduce the organization to 6 people; otherwise, the teams are archived.
• Deleting the account immediately closes the organization the person owns and cuts off the subscription, with no refund for the current period, except within the withdrawal period.

Cancellation and refund requests made through support are answered within 5 days.

Health and physical activity

GymDogs is not a medical service or a training guidance service: it does not prescribe exercises, does not set loads and does not diagnose anything. The plan is chosen by you.

Physical activity involves risks. Before starting or changing your routine, especially if you have any health condition, consult a health or physical education professional. Respect your limits: no medal is worth an injury.

Third-party services

GymDogs has optional integrations with third-party services, such as Apple Health, Health Connect, Strava, Google Health and, when available, Garmin and Wellhub. Payments are processed by Stripe and Efí. Each of these services is independent and follows its own terms and policies, which apply to you when you decide to use them.

We are not liable for failures, changes or unavailability of these services, or for incorrect data they send. The providers of these integrations make no warranty about GymDogs and are not liable for damages related to the use of GymDogs.

Intellectual property

GymDogs, the "Guaraci" and "GymDogs" brands, the design, the text, the artwork, the medals and the code belong to Guaraci or to those who licensed them. These terms do not transfer any of these rights to you. Copying, modifying or exploiting the service without written authorization is not permitted.

Liability

We work to keep GymDogs available and accurate, but it may have interruptions, due to maintenance or to failures of the internet, the app stores and third-party services.

Guaraci is liable for the damages it causes, as provided by law. It is not liable for damages caused by you, by other users, by organizations, by third-party services or by physical activity outside the guidance in section 10. Nothing in these terms limits the rights guaranteed to you by the CDC (Brazilian Consumer Protection Code).

Changes to the service and to these terms

We may update these terms to keep up with changes in the service or in the law. Relevant changes will be announced in the app or by email at least 30 days in advance, unless the law requires a shorter period. If you do not agree, you can cancel your plan and delete your account before the change takes effect; anyone with a paid plan gets back the amount for the period not yet used.

Suspension and termination

We may suspend or terminate an account that violates these terms or the law, or that puts the security of the service or of other people at risk. Whenever possible, we will give notice in advance and explain the reason, and you may dispute it through support.

You can close your account at any time under Settings → Delete account; the effects are described in Delete account.

Governing law and jurisdiction

These terms are governed by the laws of Brazil. If you are a consumer, disputes are resolved in the courts of your place of residence. In all other cases, the courts of the judicial district of Sorocaba, SP, are chosen.
